General Practices: Training for Information Governance, Confidentiality, Caldicott Guardians & The Data Protection Act

Caldicott Guardian Training for General Practices within England

Introduction

This course is for Caldicott Guardians in Primary Care. All practices now need an Information Governance Lead/ Caldicott Guardian in order to meet Annex 7 of Direct Enhanced Services Specification in England and to qualify for extra points under the contract.

What does the course cover?

The main objectives:

  • to learn about the key requirements in general practice
  • to understand the implications for everyday working in this role 

The session covers:

  • The role of the Caldicott Guardian in primary care
  • The key activities in relation to the role
  • The legal framework, with particular attention to the Data Protection Act
  • Challenging situations including the effect of ERM and access to information law and its impact on the Data Protection Act 1998
  • The changing goalposts in respect of the information accessed by patients, clients and the public
  • Clinicians and confidentiality
  • Issues for medical records (electronic and manual) and corporate records
  • Practical cases and scenarios in relation to the role

Background

The management of information, including patient information is a key requirement for general practices. The “NHS Code of Practice on Confidentiality” and the Welsh equivalent set out the confidentiality requirements. The Welsh Code is more up to date in terms of related legislation.

The “Confidentiality and Disclosure of Information: General Medical Services (GMS), Personal Medical Services (PMS), and Alternative Provider Medical Services (APMS) Code of Practice” set out the requirements in respect of confidentiality for practices in England.

Welsh Health Circular 2006 (016) sets out the position in Wales:


The Specification for Direct Enhanced Services (DES)

The specification states that “practices will be required to prepare a plan that demonstrates their commitment to the DES which should include:

  • “nomination of a Caldicott Guardian”
  • “evidence of compliance with good information governance practice including clauses on confidentiality in contracts of employment, training, compliance with the Data Protection Act, Computer Misuse Act and Caldicott guardianship.”

“In addition practices should”:

  • “undertake appropriate training and demonstrate proficiency in information governance standards”.


The situation is similar in Wales, where the Welsh Health Circular 2006 (016) states:

  • “Contractors are required by virtue of their Contract to nominate a person with responsibility for practices and procedures relating to the confidentiality of personal data held by the contractor. This reflects an existing requirement that applies to all other NHS bodies, where roles such as ‘Caldicott Guardian’ or ‘Caldicott Lead’ are
    common. In primary care, this responsibility might be delegated to an appropriate member of the practice, though clinicians will need to be involved where decisions about the disclosure of confidential clinical information need to be made. Contractors should also have regard to the need for security of personal data”.


The Data Protection Act 1998

The Information Commissioner, Richard Thomas, has emphasised in his Annual Report the importance of protecting personal data. The Data Protection Act 1998 contains within it provision for the “processing” or management of personal data and how subjects of the data can access it.

Scenario

Jane Blossom is the Practice Manager and the Caldicott Guardian in Share Care Practice. One day, she walks into the open plan office behind Reception, past a full waiting room. Mary Dewflower, the Receptionist is talking loudly on the ‘phone:

“So you want some information about Fred Bloggs and his wife Edie? Yes it is a bad line, isn’t it? I’ll speak up. Who did you say you were? I’ve not heard of that department. Here we are, yes Fred and Edie Bloggs, patients of Dr Smith, on the in vitro fertilisation programme. Yes, I’ll fax that to you straight away-what was your name again? And the fax number?”

Quite a few of the people in the waiting room could hear the conversation as Mary was talking loudly.
